Code Enforcement Board of Appeals (CEBA) hears and decides appeals from decisions by Code Enforcement Officers, acting as a quasi-judicial body to ensure fairness and due process by reviewing alleged errors in code interpretation or enforcement, conducting public hearings, taking testimony, making written findings, and issuing orders to remedy violations, sometimes imposing fines or assigning hearing officers. Their core duty is to provide an independent forum for resolving disputes over code application, ensuring rules are applied equitably and efficiently.

Key Duties & Powers:
  • Hear Appeals: Decide on appeals regarding errors in requirements, decisions, or failures to act by code enforcement personnel.
  • Conduct Public Hearings: Hold fair and efficient hearings with public notice, allowing all affected parties to be heard.
  • Administer Oaths & Take Testimony: Swear in witnesses and take sworn testimony, with the power to issue subpoenas for people and evidence.
  • Make Findings & Issue Orders: Issue written decisions with factual findings explaining their rulings, and order remedies for violations.
  • Impose Penalties: Levy civil fines, as authorized, against violators.
  • Establish Rules: Create their own operating procedures and hearing rules, consistent with local ordinances.
  • Ensure Due Process: Guarantee fair treatment and legal rights for property owners facing enforcement actions. 
What They Review:
  • Disputes over property maintenance, zoning, building codes, and other local ordinances.
  • Cases involving blight, unsafe conditions, illegal construction, and lien issues. 
How They Operate:
  • They are often independent boards, sometimes with legal professionals as members, separate from the enforcement agency itself.
  • Decisions are documented in writing and provided to the appellant and the enforcement officer.
